Welcome to Sivra Trading.
These Terms & Conditions govern your use of the Sivra Trading website and your purchase of products from us, whether the purchase is made through our website, WhatsApp, telephone, email or other approved sales channels.
By placing an order with Sivra Trading, you acknowledge that you have read and understood these Terms & Conditions.
1. About Sivra Trading
Sivra Trading is a Mombasa-based wholesale and retail supplier serving customers across Kenya.
Our product range includes tuk-tuk spare parts and accessories for brands and models including Piaggio, Bajaj, TVS, LML and Vespa, together with electric mobility products, solar solutions and selected hardware.
2. Product Information
We make reasonable efforts to ensure that product descriptions, photographs, specifications and availability information are accurate.
However:
- Product photographs may differ slightly from the actual product due to lighting, photography or screen settings.
- Product specifications may change because of manufacturer or supplier updates.
- Availability may change without notice.
- Some parts may have different versions depending on model, year, engine type or production series.
- “Genuine”, “OEM”, aftermarket and replacement products may have different specifications and warranties.
Where fitment is important, customers should provide accurate vehicle information before placing an order.
3. Spare-Part Compatibility
Automotive and tuk-tuk spare parts are often model-specific.
Customers are responsible for providing accurate information when requesting a part, including where relevant:
- Vehicle make
- Model
- Year
- Engine type
- Chassis or frame information
- Existing part number
- Photographs of the existing part
Sivra Trading may assist customers in identifying a suitable part, but customers should verify compatibility before installation.
Where there is uncertainty, contact our team before purchasing.
4. Prices and Quotations
Prices displayed or quoted by Sivra Trading may change because of supplier pricing, exchange rates, import costs, taxes, availability or other commercial factors.
Where a product is listed as “Call for Price” or requires a quotation, the price will be confirmed before the order is finalised.
A quotation does not constitute acceptance of an order until the applicable payment and order-confirmation requirements have been completed.
5. Orders
An order is considered confirmed when Sivra Trading has accepted the order and, where applicable, received the required payment or deposit.
We reserve the right to decline or cancel an order where:
- The product is unavailable
- There is an obvious pricing or listing error
- The product has been discontinued
- The requested product cannot reasonably be sourced
- We suspect fraudulent or unauthorised activity
- Other circumstances prevent us from fulfilling the order
Where an order is cancelled by Sivra Trading and payment has already been received, any applicable refund will be handled in accordance with our Returns & Refunds Policy and applicable Kenyan law.
6. Payment
Payment methods available to customers may include mobile money, bank transfer and other payment methods communicated by Sivra Trading.
Customers should make payments only through payment details confirmed by Sivra Trading.
Sivra Trading will never ask customers to disclose their M-PESA PIN, bank password or other confidential security credentials.
7. Delivery
We offer delivery services from Mombasa to customers in different parts of Kenya.
Delivery charges, delivery times and available courier options depend on:
- Destination
- Size and weight of the order
- Courier availability
- Delivery method
- Product availability
- Public holidays and weekends
- Circumstances outside Sivra Trading’s reasonable control
Delivery estimates are therefore estimates and not guaranteed deadlines unless expressly agreed otherwise.
8. Inspection Upon Delivery
Customers should inspect their order as soon as reasonably possible after receiving it.
If a package appears visibly damaged, customers should notify the courier where appropriate and contact Sivra Trading as soon as possible.
For wrong, missing or damaged items, customers should provide photographs and their order or invoice details to assist with investigation.
9. Returns and Refunds
Returns and refunds are governed by Sivra Trading’s separate Returns & Refunds Policy.
Customers should read that policy before purchasing.
Nothing in these Terms & Conditions is intended to remove or limit any mandatory consumer rights available under applicable Kenyan law.
10. Warranties
Where a product carries a manufacturer’s or supplier’s warranty, the applicable warranty terms will apply.
Warranty coverage may differ between products.
A warranty may not cover damage caused by:
- Incorrect installation
- Incorrect use
- Modification
- Negligence
- Electrical overload or short circuit
- Use outside the manufacturer’s specifications
- Physical damage
- Normal wear and tear
- Failure to maintain the vehicle or equipment correctly
Customers should retain their receipt, invoice or order reference for warranty claims.
11. Electrical and Electronic Parts
Electrical and electronic components can be damaged by incorrect installation, incorrect voltage, polarity, wiring faults, short circuits or other vehicle-system problems.
Customers should ensure that electrical components are installed by a suitably qualified technician.
Because electrical components may become damaged during installation, returns of electrical/electronic parts are subject to the specific Returns & Refunds Policy and any applicable manufacturer warranty.
12. Special Orders
Parts specially sourced, imported or ordered specifically at a customer’s request may be subject to different cancellation and return conditions.
Customers will be informed of applicable conditions before a special order is confirmed where reasonably possible.
13. Website Use
Customers must not:
- Use the website for unlawful purposes
- Attempt to gain unauthorised access to the website or its systems
- Introduce malicious software
- Copy or misuse website content for commercial purposes without permission
- Submit false, misleading or fraudulent information
14. Intellectual Property
Unless otherwise stated, content on the Sivra Trading website, including text, photographs, graphics, logos, trademarks and other materials, belongs to Sivra Trading or its respective licensors and may not be reproduced or commercially used without permission.
15. Third-Party Services
Sivra Trading may use third-party services such as payment providers, courier companies, hosting providers and communication platforms.
Those services may have their own terms and privacy policies.
16. Limitation of Liability
Sivra Trading will take reasonable steps to supply products as ordered and described.
To the extent permitted by applicable law, Sivra Trading will not be responsible for losses arising from circumstances outside its reasonable control, including courier delays, supplier delays, customs delays, inaccurate information supplied by a customer, incorrect installation or misuse of a product.
Nothing in these Terms & Conditions excludes liability or consumer rights that cannot lawfully be excluded under Kenyan law.
17. Governing Law
These Terms & Conditions shall be interpreted in accordance with the laws of Kenya.
Any dispute will be handled in accordance with applicable Kenyan law and the appropriate dispute-resolution procedures.
18. Changes to These Terms
Sivra Trading may update these Terms & Conditions from time to time.
The latest version will be published on the website.
